Introduction
This Parent Coaching Agreement and Consent Terms (referred to as “Agreement”, “agreement”, “Terms”, and “terms”) is by and between all coaching clients of CHILD BEHAVIOR CLINIC LLC (referred to as “You”, “you”, “Client”, and similar terms) and CHILD BEHAVIOR CLINIC LLC (referred to as “CBC”, “Practice”, “We”, “Us”, and similar terms). By submitting payment to book a coaching session with CBC, you indicate your explicit agreement to these terms. Before your first coaching session, you will be sent a customized version of this agreement for you to sign. Any signed agreement between you and CBC will supersede the agreement and terms found on this page.
Thank you for choosing to work with CBC for parent coaching services. This agreement serves to outline the terms and conditions of our coaching relationship, including payment, confidentiality, and session guidelines. Please read this document carefully before submitting your payment, which indicates your agreement to its terms. If you have already agreed to other terms and conditions from CBC, this agreement serves as an addition to any previously agreed-on terms. If any sections of this agreement conflict with other CBC terms you have agreed to, the conflicting sections from this agreement will supersede any other agreement’s conflicting sections.
Submitting a payment in order to book a coaching session with CBC indicates that you have read, understood, and agreed to the full terms of this agreement.
Coaching Relationship and Commitment
All coaching services will be provided by a coach from Child Behavior Clinic LLC (“Coach”, “coach”, and related terms), indicated by their name in the version of this agreement that you will receive after booking.
Coaching is not a substitute for medical or psychological treatment. The coaching relationship is professional in nature and focused on helping you achieve your parenting goals. You, the client, will select the focus of our sessions, determine your goals, and decide how much change you are willing to implement. There is no guarantee that coaching will result in specific outcomes for you or your child.
It is important to understand that this coaching relationship is bound by professional ethics. While coaching may feel personally significant, it should not extend beyond the professional realm either during or after our work together.
Your coach is committed to supporting you in reaching goals that improve your family’s well-being. Throughout your sessions, you can expect them to:
- Encourage the exploration of changes that can improve your family life.
- Help you define meaningful parenting goals and take actionable steps toward achieving them.
- Provide careful and empathetic listening, pose powerful questions, and give honest feedback.
- Maintain strict respect for the confidentiality of your discussions, except in cases outlined in the confidentiality section below.
In return, we expect you, as our client, to:
- Be honest with yourself and your coach.
- Commit to goals that you find meaningful.
- Take full ownership of your progress and achievements.
- Be responsible for managing your coaching time and the activities discussed in your sessions.
- Understand that coaching is a comprehensive process that may involve areas such as work, health, relationships, and it is your responsibility to implement any changes you decide upon.
Confidentiality
All information shared during coaching sessions will remain confidential except under the following circumstances:
- If you threaten or attempt to commit suicide, or conduct yourself in a manner that poses a substantial risk of serious bodily harm.
- If you threaten to cause grave bodily harm or death to another individual.
- If there is reasonable suspicion that any form of physical, emotional, or sexual abuse has occurred to a minor under 18 or to an elderly person.
- If a court orders the release of information via a legitimate subpoena.
- If you are undergoing court-ordered coaching or information is needed for an expert report.
- If CBC or your coach need to consult with other professionals on your behalf.
Video Conferencing Services and Consent
Coaching sessions are conducted via Google Meet, a video conferencing service provided by Google LLC. Although many of the services we use are HIPAA-compliant, coaching does not require HIPAA compliance and we do not guarantee HIPAA compliance for any services used during coaching sessions, except when stated otherwise.
By agreeing to these terms, you are also consenting to video conferencing sessions and agree that you understand:
- There are potential risks with technology, including interruptions, unauthorized access, and technical difficulties. Either party may discontinue a session if the connection is deemed inadequate.
- Google Meet or Google LLC do not provide emergency or urgent medical services. In case of an emergency, you must use a phone to call 911.
- The video conferencing service facilitates our coaching sessions but is not responsible for providing any medical or healthcare services.
- To maintain confidentiality, you will not share the appointment link with anyone unauthorized to join the session.
Electronic Communication
You may opt to use communication via email or text messaging for scheduling, cancellations, or inquiries. However, please keep in mind that these methods are not guaranteed secure, and confidentiality cannot be assured. Do not use email or text messaging for discussing sensitive or emergency matters.
Scheduling and Cancellation Policy
Individual parent coaching sessions are typically 45 minutes unless mutually agreed upon in advance for a longer duration. Coaching services provided through a CBC coaching subscription are typically 30 minutes long. You are responsible for logging into the video conferencing platform on time.
- Cancellation or rescheduling of coaching sessions that are not part of a subscription requires a minimum of 24 hours’ notice.
- If you cancel with less than 24 hours’ notice or miss an appointment, you will be charged the full session fee.
- If you have paid a session fee in advance and you cancel or reschedule an appointment with at least 24 hours’ notice, you will receive a credit towards a future session instead of a refund.
- If you have paid a session fee in advance and you cancel with less than 24 hours’ notice or miss an appointment, you will not be entitled to a refund.
- If you are late to a session, the session will still end at the scheduled time, and you may lose some of your session time.
Payment Procedures
Payments for all services are required at the time of booking, unless coaching is purchased as part of a subscription. Payment methods include: Credit/debit card (processed through Stripe for individual coaching sessions and Shopify Payments for coaching subscriptions).
CBC and/or its representatives do not accept insurance payments. Coaching services are not considered healthcare services and are therefore not reimbursable by insurance.
Coaching vs. Psychotherapy
Please understand that parent coaching differs from psychotherapy. Coaching focuses on helping you manage challenging situations with your children and improving your parenting skills. It is designed to help you reduce stress, improve family relationships, and gain confidence in your parenting.
Coaching does not diagnose or treat mental disorders as defined by the American Psychiatric Association, nor is it a substitute for counseling, psychotherapy, psychoanalysis, or any other mental health services.
If you are currently in therapy or under the care of a mental health professional, it is recommended that you consult with them before beginning coaching. Agreeing to these terms indicates that you have notified them of your decision to work with a coach.
Emergency Policy
Coaching services are not equipped to handle emergency situations. If you believe you are in a crisis or need immediate assistance, please dial 911 or contact your nearest emergency room. Note that telephone calls and electronic communications with CBC or its representatives outside of session times will typically be responded to within 24 hours, but are not intended for emergency issues.
Disclaimer of Warranties
We strive to provide high-quality resources and tools, but remember, every child is unique, and our guidance shouldn’t replace personalized professional healthcare if needed.
CBC PLATFORMS, PRODUCTS, SERVICES, AND ALL ASSOCIATED CONTENT, INCLUDING INFORMATION PROVIDED BY DR. JACQUE BOGDANOV OR OTHER CBC REPRESENTATIVES, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CBC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ACCURACY, COMPLETENESS, RELIABILITY, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
Understanding the Limits of Educational Resources
We strive to provide the best possible information and support on child behavior, anxiety, and ADHD. However, it’s essential to understand the following:
- Not a Substitute for Individualized Care: Our resources do not replace a diagnosis, personalized treatment plan, or the ongoing care of a qualified mental health or medical professional. While offering valuable information, our products and services cannot meet the same criteria as one-on-one therapy or specialized medical expertise.
- We Do Our Best, But Things Change: We work hard to keep our content accurate and up-to-date. Despite this, research evolves, techniques change, and every single child is unique. There’s no guarantee our resources will perfectly suit your family’s needs at every single moment.
- Protecting Our Ability to Help: Unfortunately, it’s legally necessary to limit our liability. This reflects the educational nature of our services and safeguards CBC so we can continue providing resources to families like yours. We understand this doesn’t offer solutions in every unlikely negative scenario, but it enables us to keep creating content and tools.
Why This Matters: We want you to benefit from CBC! To truly make a difference for your child, combining our resources with the right professional support is essential.
Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW, IN NO EVENT SHALL CBC, ITS EMPLOYEES, AFFILIATES, OR REPRESENTATIVES BE LIABLE FOR ANY DAMAGES (DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE) ARISING FROM YOUR USE OF, INABILITY TO USE, OR RELIANCE ON OUR PLATFORMS, PRODUCTS, SERVICES, CONTENT, OR ANY INTERACTIONS WITH OTHER USERS. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL BASIS FOR THE CLAIM, EVEN IF ADVISED OF THE POSSIBILITY OF DAMAGES.
Resolving Disputes Amicably
We prioritize your satisfaction and aim to resolve any concerns or disputes in a manner that is fair and amicable. In the event of a concern or dispute related to our Platforms, products, or services, we encourage you to first contact our customer support team at info@childbehaviorclinic.com. We pledge to work diligently to address your concerns promptly, aiming for resolution within 30 days of your initial contact.
Step-by-Step Dispute Resolution
- Initial Contact: Reach out to our customer support team with a detailed account of your issue, including any relevant documentation or communication. Please include your preferred outcome or resolution.
- Internal Review: Upon receipt of your complaint, we will conduct a thorough internal review. This process may involve contacting you for additional information or clarification. Our goal is to understand fully and address your concerns to your satisfaction.
- Mediation: If we are unable to resolve your dispute internally to your satisfaction, we encourage parties to seek mediation, a form of alternative dispute resolution (ADR), as a next step. Mediation will be conducted by a neutral third party, chosen jointly by you and Child Behavior Clinic, at a mutually agreed upon time and location. The costs of mediation will be shared equally between both parties unless otherwise agreed.
- Legal Resolution: In the unlikely event that mediation does not result in a resolution, this agreement does not preclude either party’s right to seek relief through legal channels if necessary.
This step-by-step process is designed to encourage the resolution of disputes in the most amicable and efficient manner possible. By following this process, we hope to foster understanding and mutually beneficial outcomes, conserving both time and resources for all parties involved.
Changes to Terms and Platforms
CBC maintains the right to update or modify these Terms at any time. Updated versions will be posted on our Platforms, and the “Last Updated” date will be revised. Your continued use of the Platforms after such updates constitutes your acknowledgment and acceptance of the modifications.
Jurisdiction and Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Wisconsin, USA without regard to any conflict of laws provisions. Any disputes arising from these Terms or your use of CBC services shall be resolved exclusively in the appropriate courts within Wisconsin.
International Users
- U.S.-Based Services: Child Behavior Clinic is headquartered in the United States. Our Platforms are designed primarily for users within the U.S. and compliance with U.S. laws. If you access our Platforms from outside the U.S., you do so voluntarily and acknowledge that CBC makes no guarantee that content or service availability is suitable for your location.
- Responsibility for Compliance: Compliance with relevant laws, regulations, and privacy standards of your jurisdiction is your own responsibility when accessing our Platforms from outside the U.S.
- Data Transfer Consent: By using our Platforms, you expressly consent to the potential transfer of your personal data to the United States for processing in accordance with our Privacy Policy.
- Non-U.S. Jurisdiction: This website and its operation are primarily intended to subject CBC to the jurisdiction and laws of the United States.
- Data Rights Inquiries: While CBC makes no claims as to GDPR compliance, we recognize the rights of individuals over their data. Should you believe you possess additional rights under privacy laws of your specific jurisdiction, please contact us at privacy@childbehaviorclinic.com and we will address your request within a reasonable timeframe to the best of our ability.
Severability
If any provision of these Terms is deemed invalid or unenforceable by a court, the remaining provisions shall remain in full effect.
